TERMS OF SERVICE

These Terms of Service (“Terms”) govern the use of MegaSaversAuction.com and all related services
provided by Mega Savers Auction (“Mega Savers,” “we,” “our,” or “us”). By registering for an account,
placing a bid, or purchasing items through our auction platform, you agree to be legally bound by these
Terms.
If you do not agree to these Terms, you must not use this website or participate in any Mega Savers
auctions.
1. Eligibility
You must be at least eighteen (18) years of age to register or participate in any Mega Savers Auction
service.
By creating an account, you represent and warrant that:
● The information you provide is accurate and complete.
● You are legally capable of entering into binding contracts.
● You are responsible for all activities conducted under your account.
You are responsible for maintaining the confidentiality of your account credentials and password.
Mega Savers shall not be liable for any unauthorized use of your account.
2. Binding Nature of Bids
All bids are final and legally binding.
By placing a bid, you agree to purchase the item if you are the winning bidder. Failure to complete
payment constitutes a breach of these Terms.
Mega Savers reserves the right to:
● Charge the payment method on file
● Suspend or terminate accounts
● Recover damages, fees, or collection costs arising from non-payment
3. Payment Terms
Payment and buyer’s premium:
A buyer’s premium of 18%, plus a $2.5 auction item fee per lot, applies to all auctions.
The credit card on file will be automatically charged following the close of the auction without prior
notice.
For invoices exceeding $500 CAD, payment must be made via bank wire transfer or e-transfer.
Payment instructions will be provided with the invoice.
Mega Savers reserves the right to:
● Decline payment methods
● Require alternate payment methods
● Cancel or suspend orders where payment cannot be processed.
Failure to remit payment within the required timeframe may result in account suspension or
permanent account termination.
4. Pickup Requirements
All items must be picked up within fourteen (14) days from the date of arrival notification.
At the time of pickup, the customer must:
● Present valid government-issued identification
● Be ready to receive the email verification code
● Sign the pickup documentation
By signing for the goods, the customer acknowledges and confirms that:
● The items listed on the invoice have been received
● The items have been inspected
● The items are accepted in their current condition
● No undisclosed defects are present at the time of pickup
Any claims for missing items will only be accepted if reported before leaving the premises. Once
the customer leaves the store, all sales are considered final, and Mega Savers Auction will not be
responsible for any missing items.
5. Failure to Pick Up / Abandoned Property
If items are not picked up within fourteen (14) days and no prior arrangements are made, the order will
be considered abandoned property.
In such cases, Mega Savers reserves the unrestricted right to:
● Resell the item
● Dispose of the item
● Re-auction the item
● Otherwise handle the item at its sole discretion
No refund, credit, or compensation will be provided for abandoned items.
The customer shall be deemed to have irrevocably forfeited ownership rights to the items.
6. Alternative Options Before Pickup Deadline
Prior to the pickup deadline, the customer may request one of the following:
Shipping Request
Customers may request home delivery before the pickup deadline. Shipping costs will be calculated
and invoiced. Items will be shipped only after full payment of shipping charges has been received.
Mega Savers is not responsible for damage occurring during shipping once the item leaves our
facility.
Order Cancellation
Customers may cancel a purchase before the pickup deadline by paying a restocking fee of thirty
percent (30%) of the sale price, with a minimum charge of $15 per lot, plus applicable taxes.
The remaining balance will be issued as auction credit only.
7. Buyer’s Remorse
If a winning bidder no longer wishes to complete the purchase (“buyer’s remorse”), cancellation may be
permitted only if:
● The restocking fee has been paid, and
● The request is received before payment or pickup deadlines.
● The lot was not listed in 1/3 condition, nor was it sold “AS IS” (for example, mystery lots,
Gaylords, etc.).
Failure to meet these conditions will result in the purchase remaining valid and enforceable.
8. Warranty Policy
Mega Savers provides a seven (7) day limited warranty only for items not explicitly marked “AS
IS.”
The warranty covers material discrepancies between the listing description and the item
received.
Items marked “AS IS” are sold without any warranty, guarantee, or representation, either
expressed or implied.
Warranty claims must be submitted within seven (7) calendar days of receiving the item by contacting:

Mega Savers reserves the right to determine the appropriate remedy, which may include:
● Partial credit
● Refund as auction credit
● Return for auction credit
● Replacement (if available)
9. Return Eligibility
Returns will not be accepted for items that are:
● Assembled
● Installed
● Used
● Missing original packaging
● Altered or modified
Customers must contact Mega Savers before assembling or installing items if any issue is
suspected.
Shipping damage claims must be addressed directly with the carrier where applicable.
10. Product Descriptions and Item Condition
Mega Savers makes reasonable efforts to provide descriptions and images; however:
● Descriptions represent general opinions based on visual inspection
● Descriptions are not guarantees of functionality, completeness, or value
Mega Savers does not warrant that product descriptions or website content are:
● Accurate
● Complete
● Reliable
● Error-free
Buyers are solely responsible for ensuring that items are suitable for their intended purpose.
11. Manufacturer Warranties
Items sold by Mega Savers are not covered by manufacturer warranties.
Mega Savers is not affiliated with manufacturers and assumes no responsibility for manufacturer
defects.
12. Product Safety and Legal Compliance
Buyers are solely responsible for ensuring that purchased items comply with all applicable laws,
regulations, and safety standards.
This includes compliance with the Canada Consumer Product Safety Act (CCPSA).
Mega Savers shall not be liable for any injury, damage, or loss resulting from the use of purchased
items.
13. Taxes
All purchases are subject to applicable federal and provincial tax laws based on the location where
the item is picked up.
All taxable items will be charged GST and any applicable provincial taxes.
14. Fraudulent or Non-Paying Bidders
Mega Savers reserves the right to:
● Suspend accounts
● Cancel registrations
● Refuse future participation
● Pursue collection actions
against users who:
● Fail to complete purchases
● Submit fraudulent bids
● Abuse auction privileges.
15. Right to Refuse Service
Mega Savers reserves the right, at its sole discretion, to:
● Cancel auctions
● Reject bids
● Remove bidders
● Terminate accounts
● Refuse service
at any time, with or without cause and without liability.
16. Limitation of Liability
To the maximum extent permitted by law, Mega Savers shall not be liable for any:
● Direct damages
● Indirect damages
● Consequential damages
● Loss of profits
● Loss of business
● Personal injury
● Property damage
arising from the purchase, use, or handling of auction items.
All items are purchased at the buyer’s own risk.
17. Modifications to Terms
Mega Savers reserves the right to modify these Terms at any time.
Updated terms will be posted on the website and will take effect immediately upon publication.
Continued use of the platform constitutes acceptance of the revised Terms.
18. Severability
If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions
shall remain fully valid and enforceable.
19. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of
Alberta and the applicable laws of Canada.
Any disputes shall be resolved in the courts located within Alberta, Canada.
